EXECUTIVE ORDER
86-26

WHEREAS, the "Missouri State Park Board" was created by the General Assembly in 1953; and

WHEREAS, the "Missouri State Park Board" was transferred by Type I transfer to the Department of Natural Resources in Section 10.3 of the Reorganization Act of 1974; and

WHEREAS, the "Missouri State Park Board" was assigned an advisory role by the Department of Natural Resources pursuant to the Reorganization Act (Appendix C, RSMo 1978); and

WHEREAS, it is necessary and desirable that an advisory board continue to serve the Department of Natural Resources.

NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, pursuant to the authority vested in me by the Constitution and laws of the State of Missouri, hereby establish the Missouri State Park Advisory Board. The Missouri State Park Advisory Board shall consist of six members, to be appointed by the Governor, who shall serve without compensation other than for their reasonable and necessary expenses incurred.

Of the members first appointed, two members shall be appointed for a term of one year; two members shall be appointed for a term of two years; and two members shall be appointed for a term of three years. Each member subsequently appointed shall be appointed for a term of three years from the date of the expiration of the term for which his predecessor was appointed; except, that any person appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall serve for the unexpired term of such predecessor. All members shall continue in office until the successors have been duly appointed and qualified.

Staff assistance for the Board shall be provided by the Department of Natural Resources.

Within thirty days after appointment, the members shall meet and organize and select one of their members as chairman, who shall serve one year and until his successor is selected. The Board shall meet as often as necessary to provide timely and appropriate advice but not fewer than two times a year. The Board may hold meetings in any part of the state. Meetings shall be held on the call of the chairman, the Director of the Department of Natural Resources, or upon the request of four members of the Board. A majority of the Board shall constitute a quorum for the transaction of business.

The Missouri State Park Advisory Board shall serve in an advisory capacity to the Department of Natural Resources for all matters relating to the acquisition, development, and operation of the Missouri state park system.

The Board may, when it deems necessary or upon the request of the Director of the Department of Natural Resources, conduct a public hearing on a matter or matters under consideration: Such hearing shall be held at a time and place deemed by the Board to be appropriate, but only after due public notice.

The Board shall consult with the Department of Natural Resources and prepare an annual report containing the current conditions of the state park system and recommending future improvements which may be necessary. The annual report shall be sent to the Governor, members of the General Assembly and made available to interested citizens.

This Executive Order shall be effective immediately, and shall supersede and be in lieu of all previous Executive Orders pertaining to the same subject. The Missouri Advisory Council on Historic Preservation created by previous Executive Orders shall continue to exist, and shall continue to exercise that authority previously provided.
