EXECUTIVE ORDER
87-5

WHEREAS, the Congress has passed and the President has signed the Superfund Amendments and Reauthorization Act of 1986; and

WHEREAS, Title III thereof, the "Emergency Planning and Community Right-To-Know Act", requires the Governor to appoint a State Emergency Response Commission; and

WHEREAS, the Act sets out additional responsibilities to be accomplished within specified time constraints; and

WHEREAS, it is appropriate to create a state commission to oversee the state's responsibilities under the law.

NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the powers vested in me by the Constitution and laws of the State of Missouri, do hereby create and establish the Missouri Emergency Response Commission. This Commission shall consist of six members, as follows: the Direct of the Department of Public Safety, or his designee; the Director of the Department of Natural Resources, or his designee; the Director of the Department of Health, or his designee; three members appointed by the Governor, one to represent the Missouri chemical industry, on to represent local governments, and one to represent the general public. The members appointed by the Governor shall serve a term designated by the Governor at the time of appointment.

The Missouri Emergency Response Commission shall have full authority and responsibility to do those things required of it under the Emergency Planning and Community Right-To-Know Act of 1986. The Commission shall make every possible effort to minimize the reports of filings required of private and public entities in Missouri, and shall establish a single filing point for all private and public entities.

In addition to the responsibilities imposed under the Act, the Commission shall examine the federal and state laws, and possible sources of private, local, federal and state funding, and within one year from today's date, provide the Governor with a written report and proposal as to how the state should respond to the mandates contained in the Emergency Planning and Community Right-To-Know Act of 1986.

The Department of Natural Resources is hereby designated as the lead agency for state compliance with the Act. The Department of Natural Resources shall provide staff support to the Commission pending the Commissions's report required by this Executive Order.
