EXECUTIVE ORDER
92-21

WHEREAS, in Executive Order 85-10, Marilyn Leistner was appointed as trustee for the City of Times Beach, Missouri; and

WHEREAS, as trustee, she prosecuted and defended to final judgment all suits instituted by or against the City; collected all monies due the same; liquidated all lawful demands against the same; condemned property as required to take title to property as it was acquired; taken over all records of the City; and generally performed all acts necessary to effectuate and comply with the provisions of the four-party Superfund contract for the permanent relocation of the residents and businesses of Times Beach, Missouri; and

WHEREAS, as trustee, she has closed the affairs of the City; has paid all debts due by the City; has paid over to the State Treasurer any money remaining on hand; and has delivered to the Missouri Department of Natural Resources all books, papers, records and deeds to acquired property belonging to the disincorporated city; and

WHEREAS, as trustee, she has closed the affairs of the City; fully discharged her duties under Executive Order 85-10; and submitted a final report and account which fully details all of the trustee's acts performed in and about the execution of her appointment as trustee.

NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, hereby fully discharge and release Marilyn Leistner from such duties and obligations imposed by Executive Order 85-10 relating to her appointment as trustee for said City.

It is so ordered.
