EXECUTIVE ORDER
NO. 93-09
WHEREAS, the Forensic Service Unit is an administrative unit of Comprehensive Psychiatric Services of the Department of Mental Health; and
WHEREAS, the purpose of the Forensic Service Unit is to evaluate criminal defendants who have been cort ordered to determine competency to stand trial and/or responsibility at the time of teh offense and other questions as stated further in Section 552.015 RSMo; and
WHEREAS, the Forensic Service Unit is statutorialy required to treat and provide public safety for those defendants court ordered to the Department of Mental Health as incompetent to proceed to trail and not guilty by reason of mental disease or defect; and
WHEREAS, the Forensic Service Unit must inform the court that the person for whom release is sought is not likely to be dangerous to others; and
WHEREAS, the Forensic Service Unit is statutorialy mandated to provide follow-up for any defendants found not guilty by reason of nemtal disease or defect while on court ordered return to the community; and
WHEREAS, the Forensic Service Unit is required to consider public safety in maintaining such indificuals in the community; and
WHEREAS, the Forensic Service Unit is the only state agency in the State of Missouri that conducts such evaluations and treatment; and
WHEREAS, the Forensic Service Unit needs access to the National Crime Information Center (NCIC) and the Missouri Uniform Law Enforcement System (MULES) computer databases to perform its duties as a criminal justice agency more efficiently; and
WHEREAS, the NCIC requires the Governor designate forensic services by executive order as a criminal justace agency before access to aforementioned databases are authroized.
NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, hereby designate the Forensic Service Unit of the division of Comprehensive Psychiatric Services of the Missouri Department of Mental Health as a Criminal Justice Agnecy for the purpose of gaining access to the computerized databases administered by the National Crime Information Center and the Missouri Uniform Law Enforcement System.
