EXECUTIVE ORDER
93-18

WHEREAS, many Missouri citizens, have experienced the loss of personal property and subsistence due to the 1993 flood; and

WHEREAS, it is the mission of the State of Missouri to maintain or improve the quality of life for the people of the State of Missouri; and

WHEREAS, the Department of Corrections desires to utilize certain Class A and B felons to assist in the emergency flood relief effort; and

WHEREAS, it is in the best interest of the services and programs of the State of Missouri to encourage the temporary release of these specified felons on Electronic Monitoring (house arrest) for the purposes of assisting flood relief efforts.

NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, including Section 44.100, RSMo, do hereby order that the restriction to Class C and D felons as enumerated in Mo. Rev. Statute, Section 217.541 with respect to the program of house arrest, be temporarily lifted in order that the Department of Corrections through its Director may adopt a program wherein Class A and B felons may be electronically monitored for purposes of assisting flood relief or cleaning up or any other volunteer assistance they can provide.

IT IS FURTHER ORDERED that this program adopted under this order will adhere to the following terms and limitations:

  1. Only Class A and B felons who have one year or less remaining prior to release on parole, conditional release, or discharge, are permitted in this program if otherwise qualified in accordance with Departmental guidelines, which includes only those who have demonstrated good institutional conduct.
  2. The Class A and B felons as described above must be on electronic monitoring in accordance with restrictions imposed on all other participating offenders.
  3. This authorization shall cover only situations created as a result of the 1993 flood.
