EXECUTIVE ORDER
NO. 98-01

WHEREAS, expanded uses of the State's floodplains are occurring in some areas; and

WHEREAS, Governor Mel Carnahan issued Executive Order 97-08 on July 8, 1997; and

WHEREAS, it was necessary to clarify provisions in Executive Order 97-08; and

WHEREAS, Executive Order 97-09 was issued July 11, 1997 in order to clarify Executive Order 97-08; and

WHEREAS, it is necessary to further clarify provisions in Executive Order 97-09.

NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, do hereby amend Executive Order 97-09 by adding to the appendix of the attachment the following definition: "State" means any land, property or other assets owned, leased or managed by the State of Missouri.

IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the Great Seal of the State of Missouri, in the City of Jefferson, on this 21st day of January, 1998.
