EXECUTIVE ORDER

WHEREAS, on September 11, 2001, the United States was attacked by a foreign enemy intent on weakening our national infrastructure, institutions, and resolve through the application of terrorism; and

WHEREAS, on September 26, 2001, I appointed Tim Daniel as the Governor's Special Advisor on Homeland Security, making Missouri the first state in the union to appoint a liaison to the federal government for homeland security issues; and

WHEREAS, on November 9, 2001, I appointed the members of the Missouri Homeland Security Panel, the membership of which was charged with comprehensively reviewing the state of Missouri's situation with regard to homeland security, recommending changes if necessary, and identifying federal funds with which to implement the recommended changes; and

WHEREAS, the Missouri Security Panel subsequently presented me with a report and recommendations, many of which were included in landmark homeland security legislation, Senate Bill 712, which I signed into law on July 1, 2002; and

WHEREAS, there is a continuing need to assess the security of the State of Missouri, oversee the formulation of policy and actions relating to the security of the sate[sic], coordinate the various state agencies and political subdivisions that have a role that relates to state security, identify funding for ongoing security efforts, and generally advise the Governor on homeland security issues.

NOW, THEREFORE, I, BOB HOLDEN, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority placed in me by the Constitution and the Laws of the State of Missouri, do hereby establish the Missouri Security Council (the "Council"). The Council shall serve as the mechanism for ensuring coordination of homeland security-related activities between executive agencies and local political subdivisions and effective development and implementation of homeland security policies.

The Council shall have as its members the Governor, who shall serve as chairman of the Council, the Director of Homeland Security, Director of the Department of Public Safety, Director of the Department of Health and Senior Services, Director of the Department of Natural Resources, Director of the Department of Transportation, Director of the Department of Mental Health, Director of State Emergency Management Agency, Chief Information Officer of the State, State Adjutant General, Superintendent of the Missouri State Highway Patrol, State Fire Marshal, and Chair of the Public Service Commission.

The Council shall meet at the Governor's direction. When the Governor is absent from a meeting of the Council, the Director of Homeland Security shall preside over the meeting. The Director of Homeland Security shall be responsible for determining the agenda of the Council meetings, ensuring that necessary papers are prepared, posting public notice of Council meetings, and recording Council actions and recommendations.

The members of the Council shall serve without compensation. Each department or division by which a member is employed shall pay for the member's actual and necessary expenses. For administrative purposes, the Council will be located within the Department of Public Safety, which shall be responsible for providing staff support for the Council.

Furthermore, I also hereby reestablish the office of Director of Homeland Security. The Director shall serve at the will of the Governor. In addition to his duties with respect to the Council, the Director shall serve as the primary liaison to any federal Homeland Security offices or agencies and shall be responsible for advising the Governor on all state Homeland Security issues.

This order shall not be construed to alter the existing authorities of any executive agency or department, except that all executive departments and agencies are directed to assist the Council and the Director of Homeland Security in carrying out the purposes of this order.
