Statutory Amendment to Chapter 208 of the Revised Statutes of Missouri, Pertaining to Reinstating Healthcare, 2008-018

THE PROPOSED AMENDMENT

Be it enacted by the people of the State of Missouri:

Chapter 208, RSMo, is amended by adding four new sections, to be known as sections 208.1000, 208.1001, 208.1002 and 208.1003, to read as follows:

208.1100. Sections 208.1100 to 208.1103 shall be known as the “Missouri Healthcare Restoration Act”. 

208.1101. 1. Notwithstanding any provision of law to the contrary, including the provisions of chapter 208, the eligibility requirements for access to health care pursuant to sections 208.151 and 208.152 shall be no more restrictive than those in effect on January 10, 2005, when, pursuant to section 26.015, Matt Blunt became governor.
            2. Notwithstanding any provision of law to the contrary, including the provisions of chapter 208, the criteria for elderly Missourians accessing long-term care benefits, affordability standards for children accessing health care, cost-sharing requirements (including co-payments and premiums), and the provision of health care services in section 208.152 shall be no more restrictive than those requirements in effect on January 10, 2005.
            3. The provisions of this section shall become effective on August 28, 2009. 

208.1102. 1. Any employee, as defined in section 290.500, who is paid a rate that does not exceed the minimum wage as defined in section 290.502, shall have access to health care pursuant to sections 208.151 and 208.152. 
2. Any household where the sum total of household income does not exceed the minimum wage as defined in section 290.502 on a per capita basis and whose sum total of household income does not exceed two hundred percent of the federal poverty level shall have access to health care pursuant to sections 208.151 and 208.152. 
            3. Any handicapped person employed in a sheltered workshop, certified by the department of elementary and secondary education, shall have access to health care pursuant to sections 208.151 and 208.152. 
            4. The provisions of this section shall become effective on August 28, 2011.

208.1103. 1.No provider that participates in “MO HealthNet” program as defined in section 208.001 shall be paid less than the Medicare reimbursement rate for such services. 
            2. The provisions of this section shall become effective on August 28, 2011.
