EXECUTIVE ORDER
83-6

WHEREAS, federal and federally-assisted development, grant, loan, and planning activities have a significant effect on the economic, social, and aesthetic well-being of the citizens of Missouri; and

WHEREAS, the maximum benefits from these federal programs are only achieved in a framework of coordination and cooperation; and

WHEREAS, Executive Order 12372, Intergovernmental Review of Federal Programs, promulgated by the President of the United States, provides states with an opportunity to review and coordinate proposed federal financial assistance and direct federal development; and

WHEREAS, Executive Order 12372 also provides the states, in conjunction with local general purpose governments, and local special purpose governments they consider appropriate, the opportunity to develop their own processes or refine existing processes for state and local elected officials to review and coordinate proposed federal financial assistance and direct federal development; and

WHEREAS, Executive Order 12372 also provides that state and local elected officials may select which federal programs may be covered by the state and local review and comment process; and

WHEREAS, Executive Order 12372 also provides the states the opportunity to simplify and consolidate existing federally-required state plan submissions; and

WHEREAS, the State of Missouri recognizes regional planning commissions as an important forum for review and comment regarding such federal programs by local elected officials, citizens and other organizations; and

WHEREAS, the State of Missouri recognizes the special need for effective communication among local governments and other interested parties in interstate areas; and

WHEREAS, the State of Missouri desires to avail itself of the opportunities for review and comment provided in Executive Order 12372;

NOW THEREFORE, I CHRISTOPHER S. BOND, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, hereby order that all aspects of Executive Order 12372, Intergovernmental Review of Federal Programs, be implemented by the Executive Branch of Missouri State Government; and

BE IT FURTHER ORDERED, that the Office of Administration shall promulgate a "Policy Statement for State and Local Review and Comment Process," which is attached hereto and incorporated herein by reference, as the procedure to carry out such review and comment process, including a review of said process no later than six months following issuance of this Order and at such other times as may be deemed appropriate. The Office of Administration shall submit this Executive Order and attachment to the U. S. Office of Management and Budget as notification of the desire of the State of Missouri to have federal agencies make efforts to accommodate the concerns of state and local elected officials.

Policy Statement for State and Local Review and Comment Process

The Office of Administration is charged with implementing this policy as directed by Executive Order 83-6, dated March 15, 1983. This policy statement has been developed and approved by the Task Force on State and Local Review and Comment formed by Governor Christopher S. Bond on December 23, 1982.

The Office of Administration, Division of Budget and Planning, is designated as the primary point of contact to communicate state and local concerns to federal agencies within the purview of Presidential Executive Order 12372. The state's regional planning commissions (RPCs) are designated as the primary forum for local elected officials' review and comment on federal programs to be conducted, at open and public meetings. The RPCs will select from any or all of the following categories the programs which they desire to review and comment upon:

  • All categorical grant-in-aid programs identified in the Catalog of Federal Domestic Assistance;
  • Research and demonstration programs affecting states or municipalities;
  • All federal real property acquisition and construction activities, including Corps of Engineers projects and military bases;
  • Major changes in the use of land, water or real property owned or leased by the federal government;
  • The issuance or modification of licenses and permits; and
  • Planning requirements mandated by the federal government.

The review process will begin when an applicant submits a request for funds to support a project or when a federal agency proposes a new program or a change in the present system. Requests for funds should include a description of the project by type, purpose, general size or scale, estimated cost, beneficiaries, and other characteristics which will help to evaluate the application as well as to identify local governments or others having plans, programs, or projects which might be affected as a result of the proposal. A standard form will be used to present this information. Copies of applications should be directed to the Office of Administration, Division of Budget and Planning, and to the regional review agencies affected. All reviews will be conducted in a timely and expeditious manner.

At the state level, the Office of Administration will continue to list requests for federal funds on a weekly or biweekly index which is sent to state agencies, interested members of the legislature and their staff and local elected officials.
