EXECUTIVE ORDER
85-9

WHEREAS, Times Beach, Missouri is a fourth class city in a first class county with a charter form of government adjoining a city not within a county, and

WHEREAS, Times Beach, Missouri has contracted with the State of Missouri or the federal government, or both, for the acquisition of all real property by a federal or state agency because of the release of a hazardous substance that endangers the public health and welfare of Times Beach, Missouri and has resulted in a public calamity, and

WHEREAS, the Board of Aldermen of Times Beach, Missouri has approved, and the Mayor of Times Beach, Missouri has signed, an ordinance requesting disincorporation of Times Beach, Missouri, and

WHEREAS, that ordinance has been submitted to the Governor of the State of Missouri by the Mayor of the City of Times Beach,

NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, specifically Senate Bill No. 333, 83rd General Assembly, First Regular Session, do hereby approve and effectuate the disincorporation of Times Beach, Missouri, effective this date.

Notice of the disincorporation of Times Beach, Missouri shall be submitted to the Secretary of State and the County Court of the county within which Times Beach, Missouri lies.

It is so ordered.
