WHEREAS, in July, 1993, the floods in Missouri required me to declare the state a disaster area, and many water supplies were threatened or destroyed; and
WHEREAS, various beverage bottling companies in the state immediately began processing and distributing bottled water to be used by people without a safe water supply; and
WHEREAS, Section 196.365, and 19 CSR 20-1.060 require an inspection fee be paid by distributors to the Department of Health for beverages distributed within Missouri; and
WHEREAS, Section 44.100.1(4)(H) allows me to suspend or waive statutory and regulatory licensing requirements during a natural disaster; and
WHEREAS, it is in the best interests of the people of Missouri to waive the statutorily imposed inspection fee for bottled water;
NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, do hereby order that the inspection fee for bottled water be waived when the distributor is donating the beverage for flood relief.
