ORDER OF DISMISSAL AS TO RESPONDENT RAYMOND L. BARTLE

Now on the 8th day of November, 2012, the Commissioner, having reviewed this matter, issues the following findings and order: 

FINDINGS AND ORDER

  1. On April 2, 2012, Mary Hosmer, Assistant Commissioner for the Missouri Securities Division and on behalf of the Enforcement Section, submitted a Petition for Order to Cease and Desist and Order to Show Cause Why Restitution, Civil Penalties and Costs Should Not Be Imposed (the “Petition”) to the Commissioner.

  2. On April 6, 2012, the Commissioner issued an Order to Cease and Desist and Order to Show Cause Why Restitution, Civil Penalties and Costs Should Not Be Imposed.

  3. On April 20, 2012, David Cosgrove, Kurt Schafers and Mary Hodges all entered their appearance on behalf of Respondent Bartle.

  4. On May 7, 2012, Respondent Bartle, through his attorneys, submitted a Request for Hearing to the Commissioner.

  5. On November 7, 2012, The Enforcement Section, through The Division’s Chief Counsel Patrick Morgan, filed a Motion to Dismiss as to Respondent Raymond L. Bartle (the “Motion to Dismiss”).

  6. NOW, THEREFORE, it is hereby ORDERED that the Enforcement Section’s Motion to Dismiss is GRANTED, and it is hereby ORDERED that Respondent Raymond L. Bartle is DISMISSED from this matter with prejudice, and the findings and conclusions concerning Respondent Raymond L. Bartle, and only Respondent Raymond L. Bartle, recited in the C&D Order are VACATED.

  7. This Order concerns and is applicable only to Respondent Raymond L. Bartle, and does not dismiss any other Respondent in this matter nor vacate any findings or conclusions recited in the C&D Order as to any other Respondent, or vacate any findings, conclusions or ordered payments or other sanctions recited in any other order entered in this matter against any other Respondent.

  8. The Commissioner finds this Order, pursuant to Section 409.6-604(h), RSMo. (Cum. Supp. 2011), to be in the public interest and necessary for the protection of public investors, and consistent with the provisions of Chapter 409, RSMo.
